English-Speaking Criminal Lawyer in Barcelona: Fees and Legal Aid (2026)
What a criminal defence lawyer costs in Barcelona in 2026, fast-track drink-driving trials, free legal aid for foreigners, and how to hire and check a lawyer.
The short answer
Spain has no official criminal defence tariff, so in 2026 sources estimate roughly 200 to 600 euros for police-station help and 300 to 750 euros for a fast-track drink-driving trial, rising to thousands for serious cases. You get a duty lawyer and a free interpreter when detained, but the lawyer is free only if you qualify for legal aid.
A criminal defence lawyer in Barcelona typically costs about 200 to 600 euros for help at the police station and 300 to 750 euros for a fast-track drink-driving trial in 2026, and more for anything serious, because Spain has no official tariff. If you are detained you are assigned a duty lawyer and an interpreter, but the lawyer is free only if you qualify for legal aid, and that applies to foreigners too. This guide covers the fee ranges and why they differ, how legal aid works, what a fast-track trial is, and how to hire and check an English-speaking lawyer. For your rights on arrest, see our guide to the type of lawyer you need. This is general information, not legal advice.
What does a criminal lawyer cost in Barcelona in 2026?
Anywhere from a few hundred euros to tens of thousands, depending on the offence and the stage. A Málaga criminal lawyer's July 2026 article says plainly that there is no single tariff and that you should be wary of anyone who quotes a closed price without knowing your case. The ranges below are the providers' own estimates, not official figures.
- Detainee or police-station assistance: 200 to 350 euros, elsewhere 200 to 500 or 300 to 500 (Melendos, a legal referral platform, 8 January 2026).
- Arrest and initial representation: about 300 euros at the low end, 600 mid-range and 1,200 or more at the high end (Global Law Experts, 4 September 2026).
- Fast-track drink-driving trial: 350 to 750 euros (Melendos); 300 to 750 euros in the introduction and 300 to 600 euros in the FAQ of one specialist firm's page updated 16 October 2026.
- Minor offence trial: 500 to 1,000 euros (Melendos); 800 to 5,000 euros depending on the case (Global Law Experts).
- Appeal: 800 to 2,500 euros (Melendos).
- Serious offence before a provincial court: 2,000 to 10,000 euros (Melendos), or 3,000 to 25,000 euros or more (Global Law Experts).
Hourly rates are higher in the big cities. Global Law Experts lists 220 to 350 euros an hour for a senior associate and 350 to 600 euros or more for a partner in Madrid and Barcelona, and fixed fees of 300 to 5,000 euros per defined task. Melendos puts its overall range at 500 euros minimum, 1,500 average and 5,000 maximum, and its own page gives different ranges for the same service in different sections. Remember too that translation, expert reports and a court agent (procurador) are usually billed on top.
Do I get a free lawyer if I am arrested in Spain?
You are entitled to a lawyer, but the lawyer is free only if you qualify for legal aid. Spain's Constitution (article 17) says a detained person must be told promptly, in a way they can understand, of their rights and the reasons for detention, cannot be forced to testify, and has the assistance of a lawyer in police and judicial proceedings, with release or presentation to a judge within 72 hours. Global Law Experts (11 September 2026) adds that a duty lawyer is assigned at arrest regardless of means, and that interpretation and translation of essential documents are free and not conditional on your ability to pay.
Whether you pay the duty lawyer depends on a means test. The Spanish justice ministry's legal aid page says the limit is twice the public income index (IPREM) for a single person, two and a half times for a family of fewer than four and three times for four or more, using the index in force when you apply, and it cites the 2023 index of 7,200 euros a year, which would make about 14,400 euros for a single person. Because the index and thresholds can change, confirm the current figure with the bar association. In criminal cases the page says all people, including foreigners without legal residence, are covered. A firm's page says a duty lawyer can cost 600 euros or more if you do not qualify, but that is a single firm's claim.
- Where to apply: the bar association where you live, or the court handling your case, which forwards it.
- How fast: the bar association must decide on a provisional lawyer within 15 days, and the legal aid commission within 30 days of a complete file, and silence counts as approval (justice ministry page).
- What it covers: free advice, assistance for detainees, defence and representation, and exemption from court fees.
What is a fast-track trial (juicio rápido), and why does it matter?
A juicio rápido is a speedy procedure for simple, recent offences, so decisions come quickly and the defence has little time. A Barcelona criminal firm's page (16 July 2026) says it is common for drink or drug driving, driving without a licence, theft, minor injuries, threats and some domestic violence cases. A drink-driving specialist says the trial usually takes place five to ten days after the incident.
In many fast-track cases the lawyer may negotiate an agreement with the prosecutor (a conformidad), which can mean a lighter sentence in return for admitting guilt. The sources do not agree on the size of any reduction and none gives a verified figure, so ask your lawyer what an agreement would cost you in practice, including any driving ban or record, before you accept. If you do not speak Spanish, insist on an interpreter at every stage.
How do I choose and check an English-speaking criminal lawyer?
Check that the lawyer is registered with a Spanish bar, can attend police stations out of hours, and will put a stage-by-stage fee in writing. Global Law Experts says generally only a lawyer registered with a Spanish bar can appear in Spanish criminal courts, so a foreign lawyer must work with local counsel. Our guide to which type of lawyer you need and how to verify a colegiado number shows how to check a registration.
- Ask whether they speak English fluently, and whether documents and the fee agreement will be in English.
- Ask for a written quote that says what each stage includes, as the Málaga lawyer's article recommends.
- Ask what is not included: procurador, translators, experts, travel.
- Ask about surcharges for night, weekend or holiday attendance, which Melendos advises checking.
- Ask how an advance on fees (provisión de fondos) is handled and replenished.
- Ask whether they will attend the police station and whether that has its own rate.
Global Law Experts also advises not to answer questions or sign anything without a lawyer present, to ask for an interpreter and your consulate to be notified, and to note the arresting force, the station and the time. The emergency number is 112, and our emergency cheat sheet lists the other numbers. Courts weigh flight risk heavily for non-residents, so proof of ties to Spain such as a fixed address, a job or family can matter in a bail decision.
